Luxair Compensation Vouchers - Terms and Conditions

1. General 
  
1.1. These terms and conditions govern the relationship between you (also “customer”) and Luxair, Société Luxembourgeoise de Navigation Aérienne S.A., a public limited liability company (société anonyme) incorporated and existing under the laws of the Grand Duchy of Luxembourg, having its registered office at 25 rue Gabriel Lippmann, L-5365 Munsbach, with postal address at L-2987 Luxembourg, registered with the Luxembourg Trade and Companies Register under number B 4109 (further on “Luxair”). 
  
1.2. By choosing and/or using the Compensation Voucher, this evidences your full acceptance of these Terms and Conditions, which have been made available to you at the time of selection and through the email which delivered the Compensation Voucher, and also available on https://luxair.lu. 
  
1.3. No agent, employee or representative of Luxair has the authority to alter, modify or waive any of these Terms and Conditions. 
  
1.4. The following terms shall have the meaning as defined hereunder, unless the context otherwise requires:

a. Voucher(s) means the Compensation Voucher(s) and/or Residual Value Voucher(s) offered by Luxair.

b. Compensation Voucher (also ”compensation voucher”) means the voucher offered in accordance with the Regulation (EC) No. 261/2004 and the rights of passengers in the event of flight delay or cancellation linked to a flight-only ticket (for more information : https://www.luxair.lu/en/information/passenger-rights).  
The Compensation Voucher does not apply as compensation to flight delay or cancellation linked to a travel package.  
  
If the irregularity allows the customer to obtain the compensation, the amount of the compensation voucher shall be increased as follows:  
  
Flights up to 1,500 km: 350 EUR* instead of 250 EUR  (Type 1)
Flights from 1,500 km to 3,500 km: 500 EUR* instead of 400 EUR  (Type 2)
Flights of more than 3,500 km: 800 EUR* instead of 600 EUR  (Type 3)
  
*The allowance may be reduced by 50% if the arrival time of the substitute flight does not exceed the original arrival time by 2 hours (Type 1 flights), 3 hours (Type 2 flights) or 4 hours (Type 3 flights).  
  
The Compensation Voucher is valid for 2 years from its date of issuance.  
  
The Compensation Voucher is issued in the name of the passenger submitting the request. The customer can obtain a Compensation Voucher on behalf of all travel companions. If the customer choses to do so, no recourse will be accepted. 

c. Residual Value Voucher means the digital voucher sent to the customer for a flight-only ticket refund or a travel package refund in case the flight or the travel package is cancelled by Luxair, or the customer, in accordance with the Terms and Conditions of the fare family of the purchased flight-only ticket(s), or the Luxair Tours General Terms and Conditions of Sale of the purchased travel package.
  
d. Date of issuance means the date of the original issuance of the compensation Voucher.  
  
e. Expiration date means the last date on which customer can redeem his/her Compensation Voucher. The Compensation Voucher will expire on this date at the end of day: 23:59 (UTC). 
  
f. Gift Card (also “gift card”) means the digital card with a prepaid balance card that can be redeemed towards (i) the purchase of flight-only tickets on the Luxair website https://luxair.lu, on Luxair Mobile App, on Luxair Customer Service Center and Luxair Travel Stores or (ii) the purchase of travel packages, on the LuxairTours website https://luxairtours.lu, on Luxair Mobile App, on Luxair Customer Service Center, on Luxair Travel Stores and in any partner travel agency.
  
g. Designated recipient means the passenger who submitted the request for the Compensation Voucher.   
 
h. Extra Services means additional services selected by the customer with the purchase of a flight-only ticket or travel package, on the Luxair website https://luxair.lu or on LuxairTours website https://luxairtours.lu, on Luxair Mobile App, on Luxair Customer Service Center, on Luxair Travel Stores and in any partner travel agency, excluding insurance.

i. LuxairTours Promotional Code means the code offered to the customer that can be used to receive a discounted price on the purchase of travel packages, on LuxairTours website https://luxairtours.lu, on Luxair Mobile App and in any partner travel agency.

j. Luxair Promotional Code means the code offered to the customer that can be used to receive a discounted price on the purchase of flight-only tickets on the Luxair website https://luxair.lu, on Luxair Mobile App and in any partner travel agency.

2. Terms of Usage
  
2.1. The Compensation Voucher is non-refundable. It cannot be paid out in cash, or transferred against value, under any circumstances. Further sale of Compensation Voucher(s) is likewise not permitted. 
  
2.2. The Compensation Voucher can be used multiple times, within the validity period, until the total balance of the Compensation Voucher has been used completely. After the expiration date the Compensation Voucher cannot be used, renewed or reactivated, nor can any unused remaining balance on the Compensation Voucher be claimed or redeemed for cash. No refunds or credit note shall be issued for unused part of the Compensation Voucher. 
  
2.3. Compensation Voucher cannot be redeemed for the purchase of Gift Cards(s) or other Voucher(s). 
  
3. Redeem your Compensation Voucher 
  
3.1. Compensation Vouchers can only be used for (i) the purchase of flight-only tickets on the Luxair website https://luxair.lu, on Luxair Mobile App, on Luxair Customer Service Center and Luxair Travel Stores or (ii) the purchase of travel packages, on the LuxairTours website https://luxairtours.lu, on Luxair Mobile App, on Luxair Customer Service Center, on Luxair Travel Stores and in any partner travel agency. Holidays à la carte packages, Luxair City break packages or other stand-alone services available on the aforementioned websites cannot be booked with a Voucher. 
  
3.2. The Compensation Voucher can be redeemed until its expiration date, which is mentioned in the email by which the Compensation Voucher was delivered. The Compensation Voucher expires on the mentioned expiration date at 23:59 UTC. 
  
3.3. The flight must be completed at maximum 6 months after the expiration date of your Compensation Voucher. 
  
3.4. The Compensation Voucher can be redeemed during the booking process, initiated either on https://luxair.lu, or on https://luxairtours.lu, on the Luxair Mobile App, on Luxair Customer Service Center, on Luxair Travel Stores or in any partner travel agency. Before the payment page, you can enter the Compensation Voucher number and PIN Code in the respective fields.   
  
3.5. It is not possible to jointly redeem Promotional Code(s) together with a Gift card(s) or a Voucher(s) for the purchase of flight-only tickets and from Luxair websites https://luxair.lu, from Luxair Mobile App, from Luxair Customer Service Center, from Luxair Travel Stores or from any partner travel agency.

It is possible to jointly redeem a single LuxairTours Promotional Code together with a Gift card or a Voucher for the purchase of travel packages from LuxairTours website https://luxairtours.lu, from Luxair Mobile App, from Luxair Customer Service Center, from Luxair Travel Stores or from any partner travel agency.
  
3.6. Voucher(s) can be used for payment of additional travel insurance for travel packages booked from https://luxairtours.lu, from Luxair Mobile App, from Luxair Customer Service Center, from Luxair Travel Stores or from any partner travel agency.

For flight-only tickets purchased from https://luxair.lu, on Luxair Mobile App, from Luxair Customer Service Center and Luxair Travel Stores it is not possible to add Luxair’s travel insurance to your booking if you use your Voucher(s) for payment. 
 
3.7.1 In case of purchase of a flight-only ticket, the Compensation Voucher amount will be applied to the total flight fare (fare, taxes, and Extra services if selected). When making a payment with the Compensation Voucher, in case the booking amount is equal or exceeds the available credit, the Compensation Voucher will be fully used. Therefore, the entire transaction payment should be made with the Compensation Voucher or if the booking exceeds the Compensation Voucher balance, the remaining amount must be paid with another accepted form of payment: credit card (Visa, MasterCard, and American Express) or other accepted Gift Card(s) and Voucher(s). Payment with the Compensation Voucher cannot be combined with PayPal payment. If there is any credit left after your transaction, the value of the Compensation Voucher will be adjusted and will remain valid under the same conditions (no refund or extension possible). 
 
3.7.2 In case of purchase of a travel package, the Compensation Voucher amount will be applied to: 
 

• the deposit if booking is made more than 30 days before departure. The total Compensation Voucher amount will be used to cover the deposit.  
• the deposit amount is lower than the Compensation Voucher amount, only the deposit amount will be withheld from the Voucher.  
• If the deposit amount is higher than the Compensation Voucher amount, the full Compensation Voucher amount will be used and the remaining payment will need to be made with Credit Card or PayPal.  
• the total travel package price (fare and taxes, insurance, hotel and taxes, and Extra Services if selected).

When making a payment with the Compensation Voucher, in case the booking amount is equal or exceeds the available credit, the Compensation Voucher will be fully used. Therefore, the entire transaction payment should be made with the Compensation Voucher or if the purchase exceeds the Compensation Voucher balance, the remaining amount must be paid with another accepted form of payment: credit card (Visa, MasterCard, and American Express), Paypal or other accepted Gift Card(s) and Voucher(s).If there is any credit left after your transaction, the value of the Compensation Voucher will be adjusted and will remain valid under the same conditions (no refund or extension possible).  
  
3.8. You can use up to three forms of payment for one purchase, combining Gift Card(s), Voucher(s) and any accepted credit card. 
  
3.9 Any flight-only tickets paid totally or partially with Voucher(s) are non-refundable. In case the flight is cancelled by Luxair, or by the customer (in accordance with the Terms and Conditions of the fare family of the purchased ticket(s)) a Residual Value Voucher will be issued. 
 
3.10.1 Any travel package paid totally or partially with Voucher(s) are non-refundable. In case a travel package paid totally or partially with Voucher(s) is cancelled by Luxair, or by the customer in accordance with the Luxair Tours General Terms and Conditions of Sale) the portion of the travel package paid with the Voucher(s) will be returned to you under the form of a new Residual Value Voucher. 
 
3.10.2 In case a travel package paid totally or partially with Voucher(s) is cancelled and is subject to payment of cancellation fees, you will receive a new Residual Value Voucher of the same value as the initial Compensation Voucher used for the booking. 

The cancellation fees shall be paid with another accepted form of payment: credit card (Visa, MasterCard, and American Express) or via bank transfer.  If you would like to pay the cancellation fees with the Compensation Voucher used for the cancelled booking, we invite you to contact Luxair’s Customer Service Center.
 
3.11. In the event that a booking is made in full or in part with a Voucher, but the Voucher has not been successfully applied, Luxair will contact you to finalise the payment. In case the payment is not successfully completed, Luxair reserves the right to cancel the booking. 
  
4. Liability and risk of loss 
  
4.1. The risk of loss and title for Compensation Voucher pass to the Designated recipient upon our electronic transmission of the Compensation Voucher. 
  
4.2. Luxair is not responsible if any Compensation Voucher is lost, stolen, destroyed or used without recipient’s permission. Neither Luxair nor Luxair’s agent, employee or representative is obligated to request a person presenting this Compensation Voucher to identify himself/herself.  
  
4.3. Luxair does not accept any liability in the case that the email address of Compensation Voucher designated recipient is misspelled. 
  
5. Miscellaneous 
  
5.1. Luxair reserves the right to modify and otherwise change these Terms and Conditions at any time in its sole discretion. These modifications or changes shall not impact the Compensation Vouchers that have already been issued. 
  
5.2. These Terms and Conditions constitute the entire and only understanding between the Luxair and you, and replace any prior understandings or agreements (whether oral or written) relating to the subject matter hereof. 
  
5.3. The failure of Luxair to exercise any of its rights shall not be construed as a waiver or relinquishment of the future performance of any of its rights, and your obligations with respect to such future performance shall continue in full force and effect. 
  
5.4. If any clause contained in these Terms and Conditions becomes void, unenforceable or prohibited in any jurisdiction, this will not affect the validity and enforceability of the other clauses in these Terms and Conditions, or of these same clauses in other jurisdictions. In such cases, Luxair and you agree to replace the clause that is void, unenforceable or prohibited with a valid, enforceable clause in the spirit of the original. 
  
5.5. These Terms and Conditions are drafted in English. If translated into a language other than English for any purpose, the English version shall prevail and be paramount in the event of any differences, questions or disputes concerning the meaning, form, validity, or interpretation of these Terms and Conditions.  
  
5.6. These Terms and Conditions shall be governed by the laws of Luxembourg. To the extent permitted by law, you agree to submit to the exclusive jurisdiction of the courts of Luxembourg, for settlement of any dispute which might arise as a result of or in connection with these Terms and Conditions. 
  
5.7. These Terms and Conditions shall be read in conjunction with our General Conditions of Carriage, Security and Privacy Policy, Cookie Policy, Terms of Use, the Residual Value Vouchers Terms and Conditions and the Luxair Gift Cards - Terms and Conditions.
